The rights provided for by law always prevail over those established by a written or oral agreement. An agreement that states that you or your landlord have fewer rights than those given by customary law or the law is a fictitious rental agreement. The Registration Act of 1908 makes it compulsory to register a lease if the duration of the tenancy is longer than 11 months. A rental agreement exists even if there is only an oral agreement between you and your landlord. For example, you and your landlord may have agreed at the beginning of the lease on the amount of rent and when it must be paid, whether it contains fuel, or whether your landlord can decide who else can reside in the unit.
